Terms and Conditions

These terms and conditions (Terms) apply to retail sales to individuals consumers. These Terms do not apply to VS-9 charter groups or to businesses in trade.  Our general terms and conditions detailed on our website at https://www.fullers.co.nz/terms-and-conditions/ apply in addition to these Terms.  Where these Terms are inconsistent with the VS-9 terms and conditions and/or our general terms and conditions, these Terms will apply.  

 

1. Ticket Inclusions

Your ticket includes:

  • A return trip on the electric hydrofoil ferry departing from Viaduct Harbour Marina for a harbour cruise.
  • One premium beverage (either champagne, light beer or a non-alcoholic option), together with an appetiser, are included with your ticket.
  • Refreshment options may vary based on availability and cannot be substituted or changed on the day of your experience.

2. Bookings and capacity

  • Tickets are capacity-managed and subject to availability at the time of booking.
  • The hydrofoil ferry has a maximum capacity of up to 6 guests per trip.

3. Guest eligibility

  • The vessel is not suitable for children under 16 years or infants. Guests must be 16 years or older.
  • Guests aged 16 or 17 must be accompanied by a parent or guardian.
  • Given the size and safety requirements of this vessel, wheelchair access is not currently available.
  • If guests require boarding assistance, they should make contact in advance by calling 0800 FULLERS.

4. Weight Restrictions

  • The average passenger weight must not exceed 85kg; if booking as a couple or group, ensure the total combined weight does not exceed this limit.
  • The total combined weight of all guests aboard must not exceed 850kg. 

5. Hydrofoil Experience

  • The hydrofoil ferry experience is subject to operational conditions and safety considerations and regulations.
  • If the vessel cannot foil due to weather or unforeseen circumstances, you may be offered either:
    • A refund; or
    • Rebooking on another service (subject to availability and capacity).

6. Ticket validity

  • Tickets are valid only for the date and time printed at the time of purchase.
  • Tickets are non-transferable and cannot be resold or exchanged.
  • VS-9 tickets remain the property of Fullers360 and are non-transferrable except in the circumstances outlined in these Terms.

7. Changes and cancellations

  • Changes or cancellations must be made at least 48 hours prior to your scheduled departure.
  • No refunds or changes are available within 48 hours of travel.
  • Refunds will be provided if Fullers360 cancels the service for reasons within its control.

8. Force majeure and/or other circumstances beyond Fullers360’s control

  • For reasons beyond our control and/or where unforeseeable events occur, Fullers360 may delay or cancel the VS-9. Where cancellation occurs for factors beyond our reasonable control, we will engage with you to discuss what remedies may be appropriate and/or required by law. In certain circumstances, we may be able to offer you a full or partial refund, or subject to availability a VS-9 experience at a different date/time.

     

    Examples of factors beyond our control or unforeseeable circumstances include but are not limited to:  

    (a) weather events or poor weather conditions;  

    (b) civil defence and/or emergency events whereby we made need to deploy our ferries/other resources to assist in an emergency situation;  

    (c) electronic (or other) failures or breakdowns;  

    (d) pandemic; 

    (e) change in law, government directives or regulations in respect of the carriage of passengers; 

    (f) other force majeure events; 

    (g) lack of resources, including staff/crew shortages; 

    (h) health and safety issues, including a change in marine regulations/operating standards;  

    (i) Harbour master directives; or 

    (j) where the captain/skipper determines it is unsafe to undertake the experience.

9. Arrival time and safety briefing

  • Guests must arrive at least 15 minutes prior to their scheduled departure time to complete a mandatory safety briefing.
  • Late arrivals may result in denied boarding without a refund.

10. Travel information

  • No large personal items (e.g., suitcases or large backpacks) are permitted on board.
  • There are no toilet (or washroom) facilities on the vessel.

11. Missed departures

  • If you miss your scheduled departure, rebooking may be offered, subject to capacity.
  • Refunds are not available for missed departures.

12. Liability and conduct

  • Fullers360 strives to provide you with an exciting and safe experience. Please note that our crew/Skipper will run through a detailed safety briefing prior to you boarding the vessel which includes some of the vessel manoeuvres, including controlled landing and other features of the vessel design (and experience) that are unique to a hydrofoil experience compared to a passenger ferry or other boat, for example. Throughout the experience, you will need to remain seated at all times and comply with all our crew/Skipper instructions.
  • In participating in this experience, the passenger (“you”), agree and expressly acknowledge that participating in this experience carries a certain level/degree of risk and by agreeing to participate, you personally assume liability for those risk(s).  If any liability is attributed to Fullers360, our liability is limited to the ticket price paid by you to Fullers360 for this experience.
  • You also agree to the maximum extent permitted by law, to waive and release Fullers360 and it’s officers, contractors, employees and any subsidiary or related company from any liability, claims, losses and/or damages caused by injury, loss or damage to your property.
  • To participate in this experience, you should be in good health, including physical health and not suffer from an existing or underlying medical or other condition that may be aggravated by this experience. If you are unsure, we recommend you seek advice from your health/medical practitioner before joining us on this hydrofoiling experience.
  • Guests are responsible for their personal belongings. Fullers360 is not liable for lost or damaged items.
  • Disruptive or unsafe behaviour may result in denied boarding or removal from the service.
  • To the extent permitted by law, neither we, nor any of our directors, officers, employees, servants or agents accept any liability in contract, tort or otherwise for any injury, damage, loss, delay, additional expense or inconvenience caused directly or indirectly by the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control, force majeure, or any other event which is beyond our control or which is not preventable by reasonable diligence on our part. 

    The total liability of us to you in relation to these Terms (including the VS-9 Terms and our general terms and conditions) in any 12 month period, including in relation to any VS-9 ticket/experience, whether or not the liability is caused by the failure, or negligence, of us, or by any third party whether or not under the control of us, will be limited to: 

    (a) the cost of the VS-9 ticket that is the subject of the relevant claim; and 

    (b) to the extent we are liable to you for any further amount under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986, the amount of that liability. 

  • The total liability of you to us in relation to these Terms for any event, whether or not the liability is caused by the failure or negligence, of you, will be limited to the cost of the tickets that are the subject of the relevant claim.  

    Notwithstanding any other term of these Terms (including the VS-9 Terms and our general terms and conditions), except where such liability cannot be excluded by law, neither we nor you will be liable to the other for: any loss of profit, revenue, savings or opportunity, including any loss of data, (whether direct, indirect or consequential); any loss or damage which is indirect or consequential; or any special loss (even if the relevant party has been advised of the possibility of such loss). 

    The limits set out in this clause do not limit your responsibility to pay any outstanding amounts you owe us, and also don’t apply to any loss or damage caused by you or us for fraud, wilful breach or wilful damage.

13. Right to amend Terms

These Terms are valid until 30 April 2025, or such later date as may be advised by Fullers360. We reserve our rights to amend these Terms following that date. To the extent that any VS-9 tickets have been purchased by you prior to any amendment of these Terms, the unamended Terms will continue to apply to those tickets, and the amended Terms will apply to the VS-9 ticket purchased by you after the date of amendment.
